These Terms of Service ("Terms") govern services provided by Mullins Tech Solutions, a Tennessee sole proprietorship, and your use of the Mullins Tech Solutions website, customer portal, Facebook Page, and related communication channels.
By requesting or accepting services from Mullins Tech Solutions, submitting a service request, approving an estimate, submitting information through our website or customer portal, or otherwise engaging us to perform work, you agree to these Terms unless a separate written agreement states otherwise.
Mullins Tech Solutions provides IT support, network setup and repair, computer setup and repair, device installation and setup, troubleshooting, and related technology services in Hancock County and the surrounding area.
The specific scope of work, pricing, equipment, schedule, and other terms of an individual engagement may be described in an estimate, invoice, work order, support ticket, email, or other written service document ("Engagement Document"). If an Engagement Document expressly conflicts with these Terms regarding a specific engagement, the Engagement Document controls for that engagement.
By requesting service, you represent that you own or are otherwise legally authorized to permit Mullins Tech Solutions to access any device, network, account, software, file, system, or other technology you provide or make available for service.
You agree not to ask Mullins Tech Solutions to access a system, account, network, or information you are not legally authorized to access. You authorize Mullins Tech Solutions to perform the diagnostic, repair, configuration, installation, maintenance, or support activities reasonably necessary to complete the work you requested, subject to any limitations stated in the applicable Engagement Document.
Unless otherwise stated in an estimate, invoice, or other written agreement:
Failure to pay an amount properly due may result in suspension of additional services until the account is resolved.
Mullins Tech Solutions currently does not impose a standard cancellation or no-show fee. We ask customers to provide at least 24 hours' notice when practical if an appointment must be canceled or rescheduled.
If a cancellation fee, deposit, special-order charge, or other non-refundable amount applies to a particular engagement, it will be disclosed and agreed to before the charge applies.
Customers are responsible for maintaining current and adequate backups of important information before service begins.
Repair, diagnostic, malware-remediation, storage-device, operating-system, and network work can involve a risk of data loss, corruption, deletion, or reinstallation. Mullins Tech Solutions does not guarantee that customer data can be recovered or preserved.
When agreed as part of an engagement or reasonably necessary to perform requested work, Mullins Tech Solutions may create a temporary backup of customer information. Temporary backups created by Mullins Tech Solutions are generally deleted within 30 days after the engagement is completed unless a different retention period is agreed or legally required.
Customers should identify any particularly important or irreplaceable information before work begins.
If a service requires account credentials or system access:
Mullins Tech Solutions may use remote-support software with the customer's authorization. Mullins Tech Solutions does not intentionally make audio or video recordings of remote-support sessions and does not routinely record the contents of remote sessions.
Remote-support software or related infrastructure may automatically generate basic technical or connection logs.
Devices and networks submitted for service may already contain malware, unauthorized access, corrupted data, insecure configurations, or other compromises.
Remediation may require removing files or software, isolating systems from a network, resetting credentials, reinstalling software or an operating system, restoring or replacing data, changing network configurations, or performing a factory reset.
We will discuss significant remediation actions with you when reasonably practical. Immediate containment actions may sometimes be necessary to reduce an active security risk to your systems, other customers, or third parties.
Hardware, replacement parts, software, licenses, subscriptions, and other third-party products may be subject to warranties and terms provided by their manufacturers, developers, or vendors.
Mullins Tech Solutions does not manufacture those products and does not independently extend or replace a manufacturer's warranty unless we expressly agree otherwise in writing. Where reasonably practical, we will provide available manufacturer-warranty information for products we supply or install.
Manufacturer warranty claims may be subject to the manufacturer's own eligibility requirements, exclusions, shipping charges, procedures, and time limits.
Work performed by Mullins Tech Solutions carries a 30-day workmanship warranty beginning on the date the applicable service is completed.
This warranty applies to the specific work performed by Mullins Tech Solutions. If, during the 30-day period, the same problem recurs because of an error in our workmanship, we will make reasonable efforts to correct that workmanship issue without an additional labor charge.
The workmanship warranty does not cover problems caused by unrelated or preexisting conditions, hardware or parts failure, manufacturer defects, malware or security incidents occurring after service, software or operating-system updates, customer changes or modifications, work performed by another service provider, misuse, accidental damage, environmental conditions, power issues, network-provider problems, or circumstances outside the reasonable control of Mullins Tech Solutions.
Parts and third-party products remain subject to their applicable manufacturer or vendor warranties.
Our work may depend on services or products provided by internet providers, cloud platforms, software developers, hardware manufacturers, hosting providers, telecommunications providers, payment providers, Meta, Microsoft, Google, Slack, Cloudflare, and other third parties.
Mullins Tech Solutions does not control the availability, security practices, pricing, policies, outages, updates, or actions of those third parties. We are not responsible for a failure caused solely by a third-party product or service outside our reasonable control.
When using our website or customer portal, you agree to:
We may restrict or suspend access when reasonably necessary to protect customers, systems, or services.
When you comment on the Mullins Tech Solutions Facebook Page or send us a Messenger message, automated systems may assist with receiving, organizing, or drafting a response.
Mullins Tech Solutions uses self-hosted automation and locally hosted artificial intelligence through Ollama to assist in drafting certain Facebook and Messenger replies.
A person at Mullins Tech Solutions reviews and approves suggested replies before they are intentionally sent or posted.
Facebook or Messenger responses are provided for general informational and communication purposes. Unless expressly confirmed in an Engagement Document, they do not by themselves constitute a binding quote, a guaranteed appointment, a final diagnosis, a guarantee that a problem can be repaired, or a promise regarding a specific price or completion date.
Customers should confirm important service, pricing, scheduling, and technical details directly with Mullins Tech Solutions.
We may remove, hide, report, restrict, or decline to respond to spam, abusive content, unlawful content, or content unrelated to our services where permitted by the platform. Use of Facebook and Messenger is also subject to Meta's own terms and policies.
Customers are responsible for making reasonable arrangements to retrieve equipment after being notified that service is complete or that Mullins Tech Solutions is no longer able to perform the requested work.
Equipment that remains unclaimed for more than 60 days after reasonable notice may be treated as unclaimed property, and Mullins Tech Solutions may take steps permitted by applicable Tennessee law regarding continued storage, return, collection, or other lawful disposition.
Nothing in these Terms is intended to transfer ownership of customer property to Mullins Tech Solutions automatically. Any storage fee or other charge relating to unclaimed equipment must be disclosed to the customer before that charge applies.
Technology problems can have multiple causes, and some issues cannot be fully diagnosed or resolved.
Mullins Tech Solutions does not guarantee that every technical problem can be fixed, data can always be recovered, malware can always be completely removed without reinstalling or replacing systems, a device will remain free of future problems, a third-party service will remain available, or work will be completed within a particular timeframe unless expressly guaranteed in writing.
We will make reasonable efforts to provide the services agreed upon for each engagement.
To the fullest extent permitted by applicable law, and except for liability that cannot legally be limited or excluded, or damages resulting from fraud, willful misconduct, or gross negligence:
Mullins Tech Solutions will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from a service engagement or use of our website, customer portal, Facebook Page, or related services, including lost profits, loss of use, business interruption, or loss of data.
To the fullest extent permitted by law, Mullins Tech Solutions' total liability arising from a particular paid service engagement will not exceed the amount the customer paid Mullins Tech Solutions for the service engagement giving rise to the claim.
Nothing in these Terms limits rights or remedies that cannot lawfully be waived or limited.
Our handling of personal information is described in the Mullins Tech Solutions Privacy Policy, including service and support information, temporary backups, Facebook and Messenger information, locally hosted AI processing, Slack approvals, data retention, and data access and deletion requests.
Facebook and Messenger users can also review our Data Deletion Instructions.
The Mullins Tech Solutions name, logo, original website content, and other materials created by Mullins Tech Solutions remain our property unless otherwise agreed in writing.
Third-party trademarks, software, documentation, and content remain the property of their respective owners. Customer-owned information remains the customer's information.
Ownership or licensing of custom scripts, configurations, documentation, automation, or other deliverables created specifically for a customer may be addressed in the applicable Engagement Document.
We may update these Terms from time to time to reflect changes in our services, business practices, or legal requirements. The "Last updated" date at the top identifies the most recent revision.
Changes apply prospectively unless applicable law or a separate written agreement requires otherwise.
These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where applicable law requires otherwise.
To the extent a dispute is properly brought in court and the parties have not entered into a separate written agreement specifying another lawful venue, the parties agree that an appropriate state court located in Hancock County, Tennessee will be the preferred venue.
Where federal jurisdiction applies, proceedings may be brought in an appropriate federal court with jurisdiction in Tennessee. Nothing in this section prevents either party from using a court or remedy that applicable law requires to remain available.
These Terms do not require mandatory arbitration.
If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
These Terms, together with the applicable Engagement Document and Privacy Policy, form the agreement governing the applicable service unless Mullins Tech Solutions and the customer enter into a separate written agreement.
